Opinion Letters

Even the most knowledgeable and established lawyers often find themselves confronted by a wholly unprecedented situation.  Ensuring that such novel and often complex research is done well is vital but “dropping everything” to do so is simply not an option for busy counsel.  Experienced and well-researched lawyer David Sanders bridges that gap, providing effective, thorough and rapid opinion letters on litigation, estates, contracts, small and large business questions, and many other issues.

Mr. Sanders has produced opinion letters for Canadian and American law firms and corporations such diverse matters as international wills, contested real estate deals, penalty clauses in shareholder agreements, judgment enforceability, contract disputes, and a multitude of other topics.

Complete opinion letters include full citation, explanatory footnoting and cross-referencing, cautionary notes on potential problem areas and detailing of matters that need be further investigated or researched, placing in the hands of requesting counsel all the information they need in order to best conduct their action.

 

Facta and Casebooks

David Sanders of Camberwell House has produced facta for every court level from Small Claims to Ontario's Court of Appeal, and in one case had a judge merely copy verbatim Sanders' statements of the law over into the judgment.  Counsel will, for each request, receive a properly researched, thorough, succinct and up-to-the-minute factum which is well-organized and presents the material in the most easy-to-assimilate fashion for increasingly busy and information-overloaded judges.

 

OTHER COURT DOCUMENTS

For one party:

Sanders can act as a subcontractor for counsel producing pleadings, demands for particulars, affidavits of documents, and any other key document necessitated by the Rules.    He can also do file reviews and produce first drafts of question lists for examinations for discovery.

For multiple parties in an action:

Sanders can be retained jointly by litigation counsel to produce joint materials at low, shared cost: agreed statements of fact, joint document books, agreed statements of law and other helpful joint documentation can be produced at a fraction of the cost for counsel willing to effectively collaborate, reduce their clients' costs and leave their own time free for more contested matters.

As an experienced litigator with many years of trial, motions and appellate experience, Sanders can act as an agent in London for counsel on adjournments and motions.

 

NOT-SO-JUNIOR COUNSEL

Many highly experienced sole practitioners do not operate in partnership or association but do, on occasion, require a junior on individual files; Sanders can fulfill that role on a contract basis.  Senior counsel is left free to handle the key parts of the case, secure in the knowledge that all “junior's work” is as effectively done as if they had done it themselves.  The administrative and fiscal benefits to having a junior “on call” without ongoing employee or association agreements speak for themselves.
